Rental Agreement and Use of PolarGear Services

1. Agreement to Terms
By accessing or using the services provided by PolarGear Rental, you agree to be bound by these terms. If you do not agree with any part of them, you must not use our website or rental services. These terms apply to all visits to our site and to every rental request, reservation, and use of our equipment.
2. Eligibility
You must be at least 18 years old to use our rental services. By agreeing to these terms, you represent and warrant that you are legally capable of entering into a binding contract and that the information you provide to us is accurate and complete. We may refuse service if we reasonably believe that a booking or use would breach these terms or the law.
3. Acceptable Use
You agree to use our rental equipment only for its intended purposes and in a lawful manner. You are responsible for ensuring that the equipment is maintained in good condition during the rental period and used in line with any instructions or safety guidelines we provide. Misuse, neglect, or use of equipment in a way that could endanger yourself or others may result in additional charges and termination of the rental.
4. Booking and Reservation
When you submit a rental request, we will confirm availability and send you a summary and total. A reservation is binding only once you have confirmed it and, where required, paid any deposit or full amount as specified. Dates and equipment are subject to availability; we reserve the right to offer alternatives or cancel if we cannot fulfil a booking. You must provide accurate details and inform us promptly of any changes so we can adjust the reservation where possible.
5. Payments and Refunds
All rental fees must be paid in full prior to the collection or dispatch of equipment, unless we have agreed otherwise in writing. Accepted payment methods and timing will be communicated when you confirm your booking. Cancellations made within the notice period we specify may be eligible for a full or partial refund in line with our cancellation policy; late cancellations or no-shows may result in forfeiture of fees. Refunds, where applicable, will be processed using the same method of payment where possible.
6. Equipment Care and Return
You must return the equipment at the agreed time and in the same condition as when you received it, subject to fair wear and tear. You are responsible for any loss, theft, or damage from the time you take possession until we have received and checked the equipment. If you need to extend the rental, you must contact us in advance; unauthorised late returns may incur extra charges. We may require a security deposit or pre-authorisation for certain items, which will be released or refunded after a satisfactory inspection.
7. Damage and Loss
If equipment is damaged, lost, or stolen during the rental period, you must notify us immediately. You may be liable for the cost of repair or replacement up to the current value of the item, unless the damage or loss was not caused by your fault. We will assess each case fairly and may offer a reduced charge for minor damage. Intentional misuse or failure to report damage may result in full charges and may affect your ability to use our services in the future.
8. Disclaimers and Limitation of Liability
PolarGear Rental provides equipment on an "as is" basis. We ensure it is in good working order at the start of the rental but do not guarantee suitability for every condition or use. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the rental equipment, including loss of catch, personal injury (except where prohibited by law), or property damage. Our total liability in connection with any rental is limited to the rental fee paid for that booking, except where a higher limit is required by law.
9. Dispute Resolution
If you have a complaint or dispute about our services or these terms, please contact us first so we can try to resolve it. We will acknowledge your message and respond within a reasonable time. If we cannot reach an agreement, the dispute will be resolved in accordance with applicable law. Nothing in these terms removes or limits any statutory rights you may have as a consumer.
10. Changes to Terms
We reserve the right to modify or replace these terms at any time. Material changes will be communicated to users in advance, for example by email or a notice on our website. Continued use of our services after the changes take effect constitutes acceptance of the updated terms. If you do not agree, you must stop using our services and may cancel any outstanding bookings in line with our cancellation policy.
